Refusal

By Darren Kavinoky Refusals When a person has been lawfully arrested for a DUI, they are mandated to take a chemical test. If a person refuses, his or her license will immediately be confiscated by the law enforcement officer pursuant to their authority to do so in order to send the license to the Department of Motor Vehicles (DMV) for an Administrative Per Se (APS) hearing. The refusal will be utilized in a criminal case, as a consciousness of guilt. Additionally, evidence of the refusal can be used as a sentencing enhancement, thereby increasing the punishment if convicted for DUI. The DMV receives notice of the refusal from the peace officer, along with the physical license. The DMV punishes refusals based on the number of times in 10 years the individual has refused to submit to a chemical test: First-time offenders: Where a chemical test is refused, the DMV will suspend driving privileges for one year. Second-time offenders: Where chemical test is refused, the DMV will institute a two-year revocation. Third-time offenders: Where a chemical test is refused, the DMV will institute a three-year revocation. Four + offenders: Where a chemical test is refused, the DMV will institute a four-year revocation. The California Vehicle Code defines a refusal in Section 23577. This section states that if a person is lawfully arrested for a DUI and refuses a peace officers request to submit to, or willfully fails to complete, a chemical test(s), the court will impose penalties: First-time offenders: DUI punishment will be enhanced by an additional term of imprisonment of 48 hours in the county jail Second-time offenders: DUI punishment will be enhanced by an imprisonment of 96 hours in the county jail Third-time offenders: DUI punishment will be enhanced by imprisonment of 10 days in the county jail Four + Offenders: DUI punishment will be punished by imprisonment of 18 days in the county jail. In a criminal trial, the refusal will be perceived as consciousness of guilt and the jury will be instructed of this in a special jury instruction. CALJIC states: If you find that the defendant was offered and refused a choice of a blood, urine, or breath sobriety test after [he] [she] had been made aware of the nature of the tests and their purpose, that refusal is not sufficient, standing alone and by itself, to establish the guit of the defendant but it is a fact which, if proved, may be considered by you in the light of all other proved facts in deciding whether defendant is guilty or not guilty. The weight to which this circumstance is entitled and whether or not that conduct shows a consciousness of guilt are matters for your determination. During sentencing, evidence of the refusal to take a chemical test will be utilized as a special factor justifying whether probation will be granted or not, and in determining additional or enhanced terms and conditions of probation. It may be necessary to spend additional time in jail if probation is not granted. Perhaps participation in a work furlough or work release program will be ordered. Enhanced terms of probation may include numerous hours of community service or CALTRANS work. Where a person has refused to take a chemical test, and police have taken a blood test by means of a forced blood draw, then this counts as a refusal, even though the persons blood alcohol content was measured. The U.S. Supreme Court decided that forced blood draws were constitutional if certain safeguards were followed in the seminal case, Schmerber v. California. Unfortunately, this gives law enforcement and the courts two bites at the same apple, whereby the person not only undergoes the indignity of threats and manhandling at the hands of police, but also gets enhanced penalties as stated above during sentencing. Unfortunately, with the large number of farms going out of business because of rising costs, it’s hard to find a farm close by to get your fresh picked corn. Fortunately, supermarkets are aware of this and are all competing with each other to get the freshest corn possible. The question is, how can you tell if an ear of corn is fresh and how do you keep it fresh? The answers may surprise you unless you’re experienced with this sort of thing. Hopefully though, by the time you’re done reading this article, you’ll know exactly how to pick a fresh ear of corn and how to keep it fresh once you get it home. For starters, the first thing you have to know is that corn does not stay fresh very long. So the first thing you want to do is make sure you don’t buy your corn until the day you plan on cooking it. That way you are sure to have the freshest corn possible. Of course, that doesn’t mean that the corn you find in the supermarket is going to be fresh. So how can you tell? Most people think they have to open up the corn and look at it to see if it is fresh or check the outside husk. Actually, neither of these methods is a sure fire way to tell. If it’s starting to get hard and brittle or if it has been removed, then it is not fresh. Okay, so you’ve found your fresh corn at the supermarket. The problem you now face is how to keep it fresh once you’ve brought it home. Well, actually, this is quite simple. For one thing, you don’t want to open up the husk at all, at least not until you’re ready to cook it. Once you get home, put on a large pot of water and bring it to a boil. While the water is getting ready to boil do not remove the husk from the corn. Wait until the water is boiled and then remove the husk. After you have done this, place the corn in the boiling water. Once you do this, the water will stop boiling. The final question is how long to cook the corn for. This is again, very simple. You leave the corn in the water for about 3 to 5 minutes. No longer. By doing this, you are sure to pick not only the freshest but the sweetest corn possible. Contrary to popular belief, it doesn’t matter if the corn is yellow or white. It is not the color of the corn that determines sweetness. It is how fresh it is because the sugar in corn that is not fresh turns to starch and that is why corn that isn’t fresh is also not sweet. Grandfather Clocks Have Lives As Well

By John Cheyne I pass it every morning, hurrying by the teetering eight foot tall giant which everybody calls his grandfather clock. I know it is older than me but there are certain things about it that tell me it has class, something I lack. Of course I didnt make such an entrance into the family as it did. Apparently it really was bought by my grandfather, when he was a young man sailing as a trawler skipper out of the North East Scottish port of Aberdeen. Apparently he and the crew had had several excellent voyages, which meant he had money to burn and he didnt want to salt it all away by buying a pension. In those days, it was normal to buy things that show your status, just as people do today, so ‘Grampy’ (my name for him) made no secret that he had made a special purchase. It was going to be delivered soon by a carrier, and the neighbors were all invited to view it when it had arrived. Boy, oh boy, the rumors! The favorite one was that a coffin had been bought. The packing case was the right size, after all, but nobody had seen the contents! It was probably a coffin bought on special offer, waiting to be used! When I was introduced to it many years later, it was both more grand and fascinating for the four year old boy I had become. It was huge at eight feet tall, with three brass turret toppers above its dial and a loud chime. Also it has a rather risqu parquetry roman sylph on its front door panel. Not the sort of picture a young boy should be caught examining in detail! I grew up and World War 2 intervened. We moved many times over the years since then and had quite a few scary times, but I always remembered the clock and Grampys house with affection. When ‘Grampy’ died, my father gave the clock room in the hall of his home and it followed my father round his various changes of address in England until he retired back in Scotland. This turned out to be very close to where he grew up with the clock in Aberdeen, but 600 miles away from Southampton where I met it first. When I eventually inherited it and it became a true Grandfathers clock to me, I was able to discover a bit of its history. It had originally been in a Scottish castle and had been bought by a jewellery shop owner in Inverness at an auction of a castles contents. I was able to find this out from finding the case hid a little plastic bag of old cogs and clock bits and an advertising card left by the shop that had renovated and sold the clock to my grandfather. My father was an engineer in life and always maintained it in good working order, so what I found inside wasnt a surprise. When it passes on to its next owner, lets hope it will get another comfortable place to stay and measure passing time in the grand manner!
